AN ORDINANCE OF THE CITY OF RIGGINS, IDAHO COUNTY, IDAHO PROVIDING FOR AN ADDITION TO TITLE 10, CHAPTER 2 OF THE RIGGINS MUNICIPAL CODE RELATING TO CONTROLS OF AMPLIFIED SOUND EMANATING FROM VEHICLES OPERATED OR PARKED IN A PUBLIC STREET OR UPON PROPERTY OPEN TO PUBLIC ACCESS; PROVIDING FOR STANDARDS RELATING TO EXTRAORDINARY SOUND AMPLIFICATION; PROVIDING FOR EXCEPTIONS FOR AUTHORIZED EMERGENCY OR UTILITY VEHICLES; PROVIDING FOR EXCEPTIONS FOR ADVERTISING OR SPECIAL EVENT VEHICLES; PROVIDING FOR VIOLATIONS BEING INFRACTIONS UNDER IDAHO LAW; PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE;

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OR THE CITY OF RIGGINS, IDAHO COUNTY, IDAHO, AS FOLLOWS TO WIT:

Section 1.    The shall be a new section added to the Riggins Municipal Code in Title 10, Chapter 2 which shall be codified to read as follows:

    10-2-51:    SOUND AMPLIFICATION DEVICES:

        (A)    No driver of a vehicle shall operate, or permit operation of, any sound amplification system which can be heard outside of the vehicle from a distance of 50 or more feet when the vehicle is being operated, or is parked upon a public street or highway, or private property open to public access (ie: parking lots, etc.) unless that system is being operated to request assistance or warn of a hazardous situation.

        (B)    This section does not apply to authorized emergency vehicles or vehicles operated by electric, communications, and railway companies or utility vehicles.

        (C)    This section does not apply to sound systems of vehicles used for advertising, or in parades, political or special events, unless said use is otherwise prohibited by City, County, or State law.

        (D)    Any violation of this section shall constitute an infraction and be punishable as provided for general infractions under Idaho State law;

Section 2.    All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 3.    This ordinance shall be effective upon its passage, approval, and publication in the Idaho County Free Press.

This ordinance passed by City Council after three readings on separate days at a regular meeting of the City Council held on the 11th day of December, 1995.
