AN ORDINANCE OF THE CITY OF RIGGINS, IDAHO. DEFINING AND SETTING REGULATIONS FOR PARKING AND CAMPING IN THE CLEO H. PATTERSON MEMORIAL PARK; PROVIDING PARKING AND CAMPING RESTRICTIONS IN DESIGNATED AREAS; PROVIDING FOR WARNINGS AND CREATING PENALTIES; DECLARING ANY VIOLATIONS OF THE ORDINANCE TO BE AN INFRACTION PUNISHABLE IN ACCORDANCE WITH IDAHO CODE S18-113(A); PROVIDING FOR REPEAL OF ALL OTHER ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON IT'S PASSAGE, APPROVAL AND PUBLICATION.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF RIGGINS, IDAHO COUNTY, IDAHO, AS FOLLOWS, TO WIT:

Section 1.    Parking and Camping at the Cleo H. Patterson Memorial Park shall be regulated as herein set forth:

    (A)    Parking and Camping Restricted:

        (1)    The City Council is hereby authorized to erect signs, paint curbs, or use any other traffic control devices to restrict, limit or prohibit parking and camping in designated locations within the Cleo H. Patterson Memorial Park, when such restrictions are deemed necessary for the maintenance and continued multi-use of the public park and facilities.

        (2)    It shall be unlawful for any person or persons to park or camp in such designated area, except in compliance with the direction of the signs, curb paint, or other traffic control devise or markings.

    (B)    Parking or Camping

        (1)    Day Use Only

            (a)    It shall be unlawful for any person to establish any overnight camp using tents, blankets, sleeping bags, or related equipment, or to park any auto, truck, trailer, or towed vehicle overnight in an area designated "Day Use Only - No Overnight Parking or Camping".

            (b)   Any persons parking or camping or attempting to park or overnight camp in a designated Day Use Only area shall be entitled to one warning against such action from the Police, City Council or their designated agent.  If after such warning, the parked vehicle or camp is not moved out of the designated Day Use Only area, the person or persons attempting to overnight camp or park shall be guilty of an infraction and punished in accordance with Idaho Code S18-113(A).

        (2)    Sixteen Hour Limited Parking

            (a)    Certain designated parking areas may be limited to sixteen (16) hours of continuous parking to provide and maintain roadside rest area parking. It shall be unlawful for any person or persons to park any auto, truck, trailer or towed vehicle, or camp, in these areas for a time exceeding these limitations.

            (b)    Any persons parking an auto, truck, trailer or towed vehicle, or camping in such designated areas exceeding the sixteen hour limit shall be entitled to one warning against such action from the Police, City Council or their designated agent.  If after such warning, the parked vehicle or camp is not moved out of the Sixteen Hour Parking Area, the person or persons shall be guilty of an infraction and punished in accordance with Idaho Code S18-113(A).

Section II.    All Ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section III.    This Ordinance shall be effective upon it's passage, approval and publication in the Idaho County Free Press.
