AN ORDINANCE OF THE CITY OF RIGGINS, IDAHO, EXTENDING THE HOURS OF SALE AND PERMITTING SUNDAY SALES OF LIQUOR BY THE DRINK AS PROVIDED FOR IN IDAHO CODE SECTION 23-927, AS AMENDED IN 1986, AND IDAHO COUNTY ORDINANCE NO. 30; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF RIGGINS, IDAHO;
Section 1. This ordinance is adopted pursuant tot he authority conferred by Idaho Code 23-927 as amended in 1986, which provides that a county may, by ordinance, allow the lawful hours of the sale of liquor by the drink on Sundays, Memorial Day and Thanksgiving, and may also extend the hours of sale of liquor by the drink until 2:00 o'clock a.m. It is adopted pursuant to Idaho County Ordinance No. 30, which grants the City Councils of each of the cities located within Idaho County the authority to extend the hours of sale.
Section 2. SUNDAY SALES. Liquor by the drink may be sold, offered for sale, or given away on any licensed premises under the same rules, limitations, and conditions as apply to all other days of the week.
Section 3. HOURS OF SALE OF LIQUOR.
A. No liquor shall be sold, offered for sale, or given away upon any licensed premises, and all liquor not in sealed bottles must be locked in a separate room or cabinet during following hours:
(1) Christmas from 2:00 a.m. to 10:00 a.m. the following day.
(2) On any other day between 2:00 a.m. and 10:00 a.m.
(3) On any day of a general or primary election until such time when the polls are closed.
B. Any patron present on the licensed premises after the sale of liquor has stopped as provided in Subsection A above, shall have a reasonable time, not to exceed thirty (30) minutes, to consume any beverages already served.
C. Any person who consumes or intentionally permits the consumption of alcoholic beverage upon licensed premises after the time provided for in subsection B above shall be guilty of a misdemeanor as defined in Idaho Code 18-111 and 18-113.
D. It shall be the duty of every person who is employed at or upon a licensed premises and is present upon the licensed premises during the hours and at the time set forth in Subsection A of this section, to lock up and keep locked up in a locked room or locked cabinet all unsealed containers of liquor during the hours and at the times set forth in Subsection A of this section, and any such person who fails to perform the duty provided herein shall be guilty of a misdemeanor as defined in Idaho Code 18-11 and 18-113.
Section 4. This ordinance will be in full force and effect upon its passage, approval, and publication in the Idaho County Free Press.
