AN ORDINANCE OF THE CITY OF RIGGINS, IDAHO COUNTY, IDAHO, PROHIBITING THE USE OF COMPRESSION BRAKES ON MOTOR VEHICLES WITHIN THE INCORPORATED LIMITS OF THE CITY OF RIGGINS; GENERALLY DESCRIBING COMPRESSION BRAKES, REQUIRING THAT SIGNS PROHIBITING THE USE OF COMPRESSION BRAKES BE POSTED AT TWO ENTRANCES TO RIGGINS; PROVIDING FOR A VIOLATION OF THE ORDINANCE AS AN INFRACTION AND PROVIDING PENALTIES; AND FURTHER PROVIDING FOR ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OR THE CITY OF RIGGINS, IDAHO COUNTY, IDAHO, AS FOLLOWS:

Section 1.    No person operating a motor vehicle, including a motorcycle, within the incorporated limits of the City of Riggins, which vehicle is equipped with a compression brake, shall use that brake within the City at any time.

Section 2:    Prior to enforcing the provisions of this ordinance, agents of the City shall post an appropriate sign prohibiting the use of compression brakes at the existing two entrances to the City of Riggins on US Highway #95 and any other entrances designated, and then file with the City Clerk an affidavit that the warning signs have been properly erected at the entrances.

Section 3:    After the compression brake prohibition signs have been erected by agents of the City, any person who violates the provisions of this ordinance shall be considered guilty of an infraction, and shall be subject to a fine of seventy-five dollars ($75.00) including court costs.

Section 4.    This ordinance shall be effective upon its passage, approval, and publication in the Idaho County Free Press.
